Tulsa Doctor Pleads Guilty to Fraud, Drug Charges


A Tulsa doctor pleaded guilty today in Tulsa County District Court to allegations of fraud and distributing prescription drugs without a medical basis, Attorney General Drew Edmondson said.

Patrick J. Fahey pleaded guilty and was sentenced this morning on one count of distributing a controlled and dangerous substance and one count of Medicaid fraud.

Fahey was sentenced to a five-year suspended sentence with 90 days incarceration on the distribution charge. He received a three-year suspended sentence on the fraud count. The sentences will run consecutively. Fahey was also ordered to pay $1,000 in fines, $500 in victim compensation assessments and $250 in court costs. He will also pay $13,485 in investigative costs.

The court also prohibited Fahey from practicing medicine and from working in a profession that involves, or causes him to associate with, the dispensing of prescription drugs

Fahey operated the Patrick J. Fahey Clinic of Sports, Pain and Physical Rehabilitation, P.C. Prosecutors alleged Fahey illegally distributed prescription drugs including Lortab, Oxycontin, Xanax and Adderall without medical basis. Additionally, the state alleged Fahey submitted false claims to Medicaid and Medicare, which reimbursed Fahey for the drugs he unnecessarily prescribed.

Fahey was charged March 30 after a joint investigation by the attorney general’s Patient Abuse and Medicaid Fraud Control Unit, the Drug Enforcement Agency, the FBI, the Oklahoma Department of Health and Human Services Office of the Inspector General, the Oklahoma Bureau of Narcotics and Dangerous Drugs and the Tulsa Police Department.
