States Settle Misleading Claims Issues with Dannon


Oklahoma will receive $425,000 for consumer protection issues as part of a multistate settlement with The Dannon Company, Inc., Attorney General Drew Edmondson said today.

Oklahoma joined 39 other states in settling claims that Dannon made unsubstantiated and unlawful marketing claims about the health benefits of its Activia yogurts and DanActive dairy drinks. The states alleged Dannon made unlawful claims in advertising, marketing, packaging and selling the products that were not substantiated by competent and reliable scientific evidence.

Nationally, the settlement is valued at $21 million. Oklahoma’s share, about $425,000, is designated for consumer protection projects and initiatives.

In addition to the monetary penalties, the settlement forbids Dannon from claiming these products can prevent, treat, cure or mitigate disease. Further, Dannon must possess scientific evidence to support other health, performance or safety claims for its probiotic food products.
